Terms of Use | The Quantified Self

These Terms of Use constitute a legally binding agreement between you and Eudemonia, LLC (“Company,” “we,” “us,” or “our”) concerning your access to and use of The Quantified Self mobile application and website at the-quantified-self.com (the “Services”). By accessing the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

The Services are intended for users who are at least 18 years old. By using the Services, you represent that you meet this requirement.

2. Account Registration

You must create an account to use the Services. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to update it as needed.

3. Subscription and Free Trial

The Services offer a 14-day free trial of premium features for new accounts. After the trial period, continued access to premium features (including journaling, automations, ambient health streams, dashboard trends, LLM-assisted insights, and API keys) requires an active subscription.

Subscriptions are billed through the Apple App Store. Pricing, billing cycle, and renewal terms are as displayed in the App Store at the time of purchase. You may manage or cancel your subscription through your App Store account settings.

Refunds are subject to Apple's refund policies. We do not process refunds directly.

4. API Keys and External Access

Premium subscribers may generate API keys to access the Services programmatically. API keys are scoped to specific permissions and are subject to rate limits (100 requests per minute). You are responsible for keeping your API keys secure. Compromised keys should be revoked immediately in the app settings.

5. AI-Assisted Features

The LLM-assisted journaling feature uses OpenAI's API to analyze your journal text and suggest entities and references. By using this feature, you acknowledge that your journal text is transmitted to OpenAI for processing. AI suggestions are provided as-is and should be reviewed before acceptance.

6. Health Data

The Services may access Apple Health (HealthKit) data with your permission. Health data is used solely to provide app features (automations, summaries, ambient streams). The Services are not a medical device and are not intended to diagnose, treat, or prevent any medical condition. The Services are not HIPAA compliant.

7. User Data and Content

You retain ownership of all content you create (journal entries, habits, entities, etc.). By using the Services, you grant us a limited license to store, process, and transmit your content as necessary to provide the Services.

We may use aggregated, anonymized data for analytics and service improvement. We will never sell your personal data.

8. Prohibited Activities

You agree not to:

Use the Services for any unlawful purpose
Attempt to gain unauthorized access to any part of the Services
Interfere with or disrupt the Services or servers
Reverse engineer, decompile, or disassemble the application
Use automated systems to access the Services beyond authorized API usage
Resell or redistribute the Services or API access

9. Intellectual Property

The Services, including all code, design, and content (excluding user-generated content), are owned by Eudemonia, LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Services without our written permission.

10. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Services ceases immediately.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EUDEMONIA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

13. Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Fort Bend County, Texas.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
