End User License Agreement | The Quantified Self

This End User License Agreement (“Agreement”) is between you and Eudemonia, LLC (“Company”) for The Quantified Self mobile application (the “App”), available through the Apple App Store.

1. License Grant

Subject to this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for personal, non-commercial purposes.

2. Restrictions

You may not:

Copy, modify, or distribute the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, or sublicense the App
Remove or alter any proprietary notices in the App
Use the App for any purpose that violates applicable law

3. Subscription

The App offers premium features through in-app subscriptions managed by the Apple App Store. A 14-day free trial is available for new accounts. Subscription terms, pricing, and renewal are governed by Apple's terms and displayed in the App Store at the time of purchase.

4. Health Data

The App may access Apple Health (HealthKit) data with your explicit permission. Health data is used to provide app features such as automations and ambient summaries. The App is not a medical device and is not intended to provide medical advice.

5. AI Features

The App includes optional AI-assisted features that transmit journal text to third-party AI services (OpenAI) for processing. By using these features, you consent to this data transmission. AI-generated suggestions should be reviewed before use.

6. Intellectual Property

The App and all related intellectual property are owned by Eudemonia, LLC. This Agreement does not transfer any ownership rights to you.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

9. Third-Party Beneficiaries

Apple Inc. is a third-party beneficiary of this Agreement and may enforce its terms. Apple has no obligation to provide maintenance or support for the App.

10. Termination

This Agreement is effective until terminated. Your rights terminate automatically if you fail to comply with any term. Upon termination, you must delete all copies of the App.

11. Governing Law

This Agreement is governed by the laws of the State of Delaware.
